Adoption Processes

Jennifer Fairfax works with prospecitve adoptive parents from helping them decide which path to parenthood is best for them to finalizing an adoption.  She has assisted clients in private adoptions and agency adoptions both intrastate and interstate.  In private adoptions, Jennifer will assist you in a strategy for locating a birth family through marketing and advertising and assist you as you develop a relationship with a birth mother and father.  In agency placements, she will review your agency contract, assess situations presented to you and provided support for ICPC and if finalizing your case in Maryland, Virginia or the District of Coumbia, she will handle the court proceedings.  

Jennifer works with expectant parents - if you are a birth parent who has decided to make an adoption plan, Jennifer and her family formation law offices can advise you of the options available for locating a family and advocate for you in the adoption process.  Jennifer offers all birth parents who are considering adoption a free phone or in person consultation to discuss their options.  She has represented many birth mothers and birth fathers during her career and can provide birth parents with a sounding board for an adoption plan, explain legal rights in a private placement and advocate for you through the process.

ART

Jennifer assists Intended Parents in the negotiation of a legal contract with a Gestational Carrier and obtaining a Birth Order once the Gestational Carrier is pregnant.  Jennifer works with Clients who are searching for a Gestational Carrier privately although she does not locate Gestational Carriers for Clients.  She will provide consultation on advertising and interviewing Gestational Carriers, she will interview a Carrier on your behalf,  asisst you in obtaining a review of insurance policies, arranging for the Gestataional Carrier to obtain medical and mental health clearance and handle the legal contract and court process.  For Intended Parents matched through a coordinating program, Jennifer will negotiate the contract with the Gestational Carrier and ovresee the legal process.

Jennifer Fairfax Family Formation Law Offices represents Gestational Carriers in the negotiation of their legal contract with Intended Parents when they are matched through a Coordinating or Matching Program.  Jennifer has represented Gestational Carriers for 17 years and will provide you with a review of the legal terms of the contract and explain the court process.  Jennifer represents Gestational Carriers referred to her from Coordinating programs across the country and locally and can answer questions about industry standards for legal contracts and ensure your contract covers all aspects of the process and meets your individual needs.

Jennifer handles lesbian and gay legal issues.  In fact, she has handled lesbian and gay legal issues her entire career.  She has handled second parent adoptions or gay, lesbian and heterosexual clients all across Maryland, Virginia and in the District of Columbia. What are some basic legal issues about surrogacy?

It is imperative that your attorney can and does advise you about the relevant laws in the state in which you reside and/or the state where the surrogate lives and will deliver.  You want to be working with a surrogate who lives and will deliver in a surrogacy friendly state or a state that has laws that allow for surrogacy.  Your surrogacy agreement should be drafted by the attorney admitted to practice in the state where the contract will be enforced.

How long will private adoption take?

There is a wide variety of waiting periods dependent upon a host of controllable and non-controllable factors. Generally, the average waiting period to find a woman who is expecting a child and wanting to make an adoption plan is 12 – 36 months. Waits can be dramatically shorter or longer depending on individual situations and client’s specified parameters for adoption such as gender preference, race, age of adoptive parent, number of children in family, financial limitations, and state of residence of adoptive parents and birth parents.

Types of Adoption

There are two types of adoption: International and Domestic. Domestic adoptions are further differentiated between Private Adoptions (also called Parental Placement or Independent) and Agency Adoptions (either Private Agency or Public Agency). International Adoptions are generally handled by an Agency approved by the Country where the adoption will be processed.
